1. Subject of the guarantee
Pundmann Sp. z o.o., Ul. Bytomska 49, 42-674 Karchowice, Poland grants, subject to the following terms, a manufacturer’s guarantee of two years from the date of purchase on newly manufactured mobile water heaters of the PUNDMANN brand (hereinafter the “Product”). This guarantee may be claimed by any purchaser in the supply chain. This includes, in addition to all dealers, the owner of the vehicle into which the Product was installed, as well as the workshop that carried out the installation. However, Pundmann provides the guarantee service in respect of a specific Product only once, to whoever first submits the corresponding guarantee claim to Pundmann.
For the vehicle owner, the guarantee period begins on the day the Product was installed in their vehicle; otherwise it begins on the day of purchase. These prerequisites for asserting guarantee claims must be proven by the claimant by submitting copies of original invoices or other suitable documents.
The following terms describe the further requirements, handling and scope of the guarantee. Statutory warranty rights and other statutory claims, on whatever legal basis, remain unaffected and apply free of charge alongside this voluntary manufacturer’s guarantee.
2. Guarantee case
A guarantee case exists only if the Product has an initial material defect. An initial material defect exists if, at the time of handover from Pundmann to the first buyer, the Product already deviated from the agreed condition, or from the condition necessary and customary for the agreed or ordinary use. The claimant must prove the existence of such an initial defect.
3. Guarantee services
If a guarantee case occurs and is proven, Pundmann may choose either to supply the claimant free of charge with a defect-free Product, or to refund the demonstrably paid purchase price. If the claimant purchased the Product from a workshop as part of a repair or maintenance service, the price of the Product must be shown separately on the workshop’s invoice; otherwise, reimbursement of the purchase price is excluded.
If Pundmann opts for a replacement delivery, an equivalent, functionally identical and defect-free part will be supplied, which need not fully match the defective part in model, type and batch. Claims under this guarantee are limited to the services mentioned above. The guarantee therefore does not cover repair of the defective Product or reimbursement of corresponding repair costs, nor expenses such as removal and installation costs and any consequential damage caused by a defect in the Product.
4. Guarantee handling
Guarantee claims must be submitted directly to Pundmann as the guarantor via the email address contact@pundmann.de or via our Contact & Support form. All information on which the claimant bases their guarantee claim, including a description of the defect or fault, must be submitted within the applicable guarantee period. Under this condition, the guarantee period remains preserved even if Pundmann later asks the claimant to send further information or the defective Product (at Pundmann’s expense) for further examination of the guarantee case.
Once the claimant has proven the guarantee case to Pundmann, Pundmann will inform them whether a defect-free Product will be supplied or the purchase price paid by the claimant will be refunded.
5. Matters excluded from the guarantee
The guarantee does not cover defects and faults that are not based on a material defect that already existed at the time of handover to the first buyer. This includes, in particular, the following causes: incorrect installation, failure to observe the respective vehicle manufacturer’s maintenance instructions, use of the Product in vehicles outside normal road use or in vehicles for which the Product is not suitable according to Pundmann’s published conditions of use, normal wear and tear, improper storage, handling or other subsequent modification of the Product, or other external influences.
6. Miscellaneous
These guarantee terms and the guarantee agreement concluded on their basis are subject, to the extent legally permissible, to German law, excluding the UN Convention on Contracts for the International Sale of Goods. To the extent legally permissible, the place of jurisdiction for both parties is Schöpstal, Germany, as the registered office of Pundmann.
Relationship to statutory warranty rights
This manufacturer’s guarantee exists in addition to, and independently of, your statutory warranty rights (liability for material defects). These statutory rights apply free of charge and are in no way limited by this guarantee. Information on your statutory right of withdrawal as a consumer can be found under Right of withdrawal.
